Death row convict in the Nirbhaya case, Mukesh Singh moved the court on Tuesday seeking quashing of the death penalty in the horrific 2012 gang rape and murder case in which he along with three other co-accused, has been sentenced to death.
New Delhi: Death row convict in the Nirbhaya case, Mukesh Singh moved the court on Tuesday seeking quashing of the death penalty in the horrific 2012 gang rape and murder case in which he along with three other co-accused, has been sentenced to death. The appeal is the latest move on the part of the four accused Mukesh Singh, Vinay Sharma, Akshay and Pawan Gupta to delay the inevitable.
All four accused on death row, have been sentenced to death by hanging. The execution is scheduled to take place on March 20. The Patiala house court has already issued a death voice for all the for death row convicts.
The President of India has rejected the mercy petitions of the accused in the case and all the four death row convicts have exhausted all the legal options open to them following which the Patiala house court issued a fresh death warrant.
Lawyer for the accused, A P Singh on Monday wrote to the international Court of Justice seeking its intervention in delaying the execution of the accused citing the Novel Coronavirus outbreak. However, legal experts point out that the case in question is not an international dispute between countries and his judiciable only within the framework of the Indian Constitution. It has already been decided at the highest level in the judiciary and due sentencing done. As such the ICJ has no role to play, they point out.
