No coercion or threat to cancel PPAs, government to High Court
Amaravati: The Andhra Pradesh government defended the move to cancel PPAs contending that it was well within its purview to take such a decision.
Countering the submissions of the petitioners, in High Court on Thursday, it said the state has the power to involve in the subject matter since electricity is in the concurrent list at Entry 38 and the state is competent to intervene.
The show-cause notice issued by the discoms threatening cancellation if they do not agree for negotiation is only to mean as seeking revision of the PPA terms in accordance with the procedure under the Electricity Act, the state has contended adding that it intends to move the APERC in that regard and the present Negotiation Committee was only to find if a consensus could be arrived at.
Emphasising that there was no threat or coercion on the issue, the state said that in pursuance with the GO 73 constituting expert committee, the relevant report is furnished that there are quite a few violations in the past and such fact-finding is in process.
